COMMISSION APPROVES IBM’S ACQUISITION OF MAERSK DATA AND DMDATA |

Brussels, 22 November 2004 - The European Commission has authorised, under the Merger Regulation, Ibm’s proposed acquisition of Danish Information technology (It) service providers Maersk Data and Dmdata. The Commission’s investigation has indicated that the It services sector will remain competitive and that end-users will continue to have access to multiple sources of supply. On 12 October 2004, Ibm Danmark, which belongs to the Ibm group, notified to the Commission its intended acquisition of the Danish companies Maersk Data and Dmdata from A.p. Møller-maersk, Danske Bank and Wm-data. The acquisition will provide Ibm with a deeper expertise with regard to It-services for transport and finance and a stronger presence in the Nordic region, where Maersk Data and Dmdata have their main activities. With the transaction Ibm will also enter into It service agreements with two important customers, A.p. Møller-maersk and Danske Bank who have been so far supplied internally by Maersk Data and Dmdata respectively. However, given the significant number of global viable competitors as well as the presence of local or regional competitors to Ibm in the It service market, the increase of Ibm’s market shares through the acquisition does not give rise to any competitive concerns. The Commission’s investigation has shown that Ibm’s competitors will continue to be able to participate in bidding processes and to win tenders.
