  EMISSIONS TRADING: COMMISSION FORMALLY REJECTS UK REQUEST TO INCREASE EMISSIONS ALLOWANCES  
   
  Brussels, 14 April 2005 - The European Commission formally rejected the request from the United Kingdom to increase the number of Co2 emission allowances to be granted to Uk companies, over the amount already approved by the Commission in July last year. The Commission declares the request inadmissible as it falls outside the scope for amendments allowed by its decision of last July. Prior to taking today's decision, the Commission had already conveyed its view that the Uk request could not be accepted, both in meetings with the Uk authorities and publicly. Environment Commissioner Stavros Dimas said: "Our decision should not come as a surprise since we had told the Uk authorities that its request was not acceptable. On the other hand I warmly welcome that the Uk has nonetheless chosen to issue the originally planned number of allowances, which we had approved. This will allow Uk companies to start participating fully in emissions trading." On 7 July 2004, the Commission approved the Uk national allocation plan (Nap), which envisaged the issuance of 736 million allowances (covering 736 million tonnes of Co2 emissions) to Uk companies for the trading period 2005-2007. The Commission required the Uk to extend the Nap to installations in Gibraltar and to provide certain information with regard to the new entrants' reserve. The Commission explicitly stated that - taking into account the aforementioned amendments it required – “the total quantity of allowances to be allocated by the United Kingdom according to its national allocation plan to installations listed therein and to new entrants ... Shall not be exceeded.” On 10 November 2004, the Uk authorities put forward a request to increase the total number of allowances to 756 million, last updating it on 18 February 2005. The Commission rejects the Uk request because Member States are not allowed to notify new amendments outside the scope provided by the respective Commission decision. The total quantity of allowances is a fundamental element of the Commission’s assessment. Once the Commission has taken a decision, the utmost stability of the total quantity of allowances approved is of crucial importance for the good functioning of the trading market. The Uk has announced that it will challenge the Commission decision before the European Court of Justice but in the meantime proceed with issuing allowances in line with the Commission's July 2004 decision.
